“Our members are extremely concerned about the Ministry of Justice decision for the use of PAVA spray in young offender” institutions. While we understand the need to protect the safety and welfare of staff, we see no evidence to support the reactive use of PAVA in young offender institutions. It risks heightening tensions, distrust, fear and harm of an already disproportionally vulnerable and marginalised cohort of children in our society.
“We will continue to advocate for the urgent need to address known vulnerabilities and exploitation, and to ensure effective early intervention and reform towards the restoration of safety, dignity and hope – not threat, nor fear.
“We applaud the Youth Justice Board (YJB) Serious Incidents Report for highlighting the need to recognise children involved in serious incidents as the victims of the challenging circumstances in which they live. We also welcome the reports emphasis on ethnic disparities and high rates of neurodiversity and special educational needs.
“Our members support the YJB’s emphasis on the collective efforts needed to address the root causes of adverse childhood experience including structural issues and experiences of racial discrimination. Boys from Black and Mixed backgrounds require appropriate, equitable support and safeguarding to address additional vulnerabilities, including as victims, to reduce the likelihood of their involvement in serious incidents in the community.
“The use of PAVA in adult prisons has not resulted in decreased violence. Children in youth custody are a most disadvantaged and vulnerable group.
“We support the YJB calls for the government to instead invest in sustained reform, to include increased staff levels, improved staff training and retention, effective behaviour management strategies and evidence-based programmes to improve safety.
“In the longer-term, there should be a move towards smaller, locally based units staffed by professionals who are specially trained to work with children with complex needs.
